Pardon applications for qualifying convictions — eligibility depends on your conviction date and sentence completion.

What Is a Pardon?

A pardon is granted under the Criminal Records Act (Canada) and removes your criminal record from the Canadian Police Information Centre (CPIC) database. Whether you qualify for a "pardon" or a "record suspension" depends on when your conviction occurred — the terminology and process changed in 2012 under the Safe Streets and Communities Act.

Pardon vs. Record Suspension

Pardon (Pre-2012 Convictions)

Convictions sentenced before the 2012 amendments may fall under the older pardon regime with different waiting periods and eligibility rules.

Record Suspension (Post-2012)

Convictions sentenced after March 13, 2012 are subject to the record suspension regime with updated waiting periods and expanded ineligibility criteria.

General Eligibility Requirements

  • Sentence (including probation, fines, and conditions) must be completed
  • Required waiting period must have elapsed (5 years for summary, 10 years for indictable)
  • No new criminal convictions during the waiting period
  • Conviction must not be for a scheduled sexual offence involving a minor
